This Refund and Cancellation Policy (the “Policy”) explains the cancellation, refund, and account-handling rules that apply when you purchase an Uptook virtual membership, subscription, points, Credits, or another paid digital service. A virtual membership or points purchase is treated as delivered once it has been successfully credited to your account. Except where this Policy expressly provides otherwise or applicable law requires otherwise, such purchases are non-refundable.
1. Scope
This Policy applies to subscription fees, Credit purchases, and other digital service fees collected directly by Uptook through the Uptook website, applications, and related online services operated by Uptook Pte. Ltd.
Purchases made through the Apple App Store, Google Play, or another third-party platform are collected and administered by that platform. Cancellation and refund requests for those purchases are subject to the platform’s rules and applicable law.
If an enterprise customer has a signed order form, master services agreement, or other written agreement with Uptook that contains different refund terms, that written agreement controls.
2. Subscription Cancellation and Automatic Renewal
You may turn off automatic renewal in your account’s subscription or billing settings. If that option is not available in your account, email service@uptook.io to request cancellation. Cancellation prevents the next billing-cycle charge but does not refund fees already paid for the current billing cycle. Unless this Policy states otherwise, you may continue using the service until the current billing cycle ends.
Deleting the application, ceasing to use the Platform, or closing your account does not cancel a subscription. A subscription purchased through a third-party app store must be cancelled through that store. To avoid the next renewal charge, complete cancellation before the renewal date.
3. Virtual Membership and Points Purchases
Virtual memberships, subscriptions, points, and Credits are digital entitlements delivered immediately. Delivery is complete when payment succeeds and the applicable membership term, features, seats, points, or Credits are added to the account. Once credited, the purchase is non-refundable whether or not the user has logged in, used membership features, spent points, or used Credits.
Before paying, you must verify the account, plan, term, quantity, currency, and amount. We do not accept refund requests based on selection of the wrong account or plan, a duplicate order placed by the user, a change of mind, unused entitlements, changed business needs, or failure to cancel a renewal. Duplicate or incorrect charges, unauthorized transactions, and rights required by law are handled under Sections 5 and 9.
4. Automatic Renewal Charges
When an automatic renewal charge succeeds and the renewed membership term, features, seats, points, or Credits are added to the account, the renewal is treated as credited and the charge for that billing period is non-refundable. Forgetting to cancel, not using the account, or misunderstanding the renewal date does not create a right to a refund.
You may turn off automatic renewal at any time as described in Section 2. Cancellation takes effect at the end of the current billing cycle. You may continue using the purchased entitlements during that cycle, and you will not be charged for the next cycle. Refunds required by applicable law will be handled in accordance with that law.
5. Duplicate Charges, Incorrect Charges, and Unauthorized Transactions
If the same order is charged more than once, the amount charged differs from the amount confirmed at checkout, or you reasonably believe a transaction was unauthorized, contact us within 30 calendar days after discovering the issue. Include the order number, charge date, and relevant payment evidence. After verification, we will refund any amount charged in error.
For a suspected unauthorized transaction, we may require account and payment verification, a password reset, or other security measures. Requesting a refund does not affect any right you may have to report an unauthorized transaction to your payment provider.
6. Service Failures and Discontinuation
If a core paid feature is unavailable for more than 24 consecutive hours because of a technical issue within Uptook’s control, and we have not restored the feature or provided a reasonable alternative within five business days after receiving a complete incident report, you may request a remedy within 30 calendar days after the incident. After verification, we may restore the service, provide service Credits, or extend the subscription term based on the scope of the impact. Credited virtual memberships and points are not refunded in cash unless applicable law requires otherwise.
Planned maintenance, test features, free features, third-party network or service interruptions, force majeure events, user device or configuration issues, and restrictions or suspensions resulting from a violation of the Terms of Service are not eligible under the remedy described above.
If Uptook permanently discontinues a prepaid core service without providing a substantially equivalent alternative, we will first offer an equivalent replacement service, service Credits, or an extension of the subscription term. We will issue a refund only where required by applicable law.
7. Non-Refundable Purchases and Charges
Except where this Policy expressly provides otherwise or applicable law requires otherwise, the following purchases and charges are non-refundable:
· Virtual memberships, subscriptions, seats, points, and Credits that have been credited to an account, whether or not used;
· Used Credits and charges associated with completed data searches, verification, unlocking, exports, or AI processing;
· Charges for emails, text messages, WhatsApp messages, or other third-party communications already sent;
· Separately purchased Credit packs, top-up packs, promotional packs, discounted items, complimentary Credits, and trial benefits;
· Requests based on a failure to achieve an expected level of sales, responses, delivery, or another business outcome;
· Requests based on data changing after purchase, updates to public sources, or incomplete individual records, unless an Uptook service commitment or applicable law provides otherwise;
· Foreign-exchange, cross-border, banking, or other third-party fees charged by a payment provider that Uptook cannot recover;
· Accounts suspended or terminated for violating the Terms of Service, applicable law, or third-party platform rules.
8. Credits and Promotional Benefits
Credits are non-cash entitlements used to measure service usage on the Platform. They are not electronic money and cannot be transferred, redeemed for cash, or combined between accounts. Delivery is complete once purchased or topped-up Credits are added to an account. They are non-refundable whether or not used and cannot be redeemed based on their remaining quantity or proportion. If a refund is approved because of a legal requirement or a duplicate or incorrect charge, the related Credits and promotional benefits will be removed.
Credits supplied through a free plan, trial, or promotion have no cash value. Whether a trial converts automatically to a paid subscription is governed by the terms shown at registration or checkout. If an automatic charge will occur, the price, billing period, and cancellation method should be displayed before purchase confirmation.
9. Statutory Consumer Rights
This Policy does not exclude, limit, or replace any refund, withdrawal, repair, repeat-performance, or other consumer right that cannot lawfully be excluded. If your jurisdiction provides a cooling-off period or withdrawal right for distance purchases, digital content, or digital services, those rules take priority.
To the extent permitted by law, if you expressly request that Uptook begin providing digital services during a statutory cooling-off period and acknowledge that you may lose the right of withdrawal once performance begins, your withdrawal right may end, or a refund may be reduced by a reasonable amount for performance already supplied, when Credits are used, data is unlocked or exported, marketing messages are sent, or another digital service begins.
10. Exceptional Refund Request Process
Submit a request to service@uptook.io only for a duplicate or incorrect charge, an unauthorized transaction, or a refund required by applicable law. Include the following information:
· The email address and account name registered with Uptook;
· The order number, payment date, currency, amount, and purchased plan;
· The reason for the request and any relevant screenshots or payment evidence;
· For a service incident, the time of occurrence, affected feature, error message, and troubleshooting steps already attempted.
We generally acknowledge a complete request within two business days and decide it within five business days. Complex security matters or third-party payment disputes may take longer. Approved refunds are normally returned to the original payment method in the original currency. Funds typically arrive within 5 to 10 business days, but the timing is determined by the bank, payment provider, or app store.
A request involving a virtual membership, subscription, points, or Credits that were correctly credited to the account will not enter refund review. Before submitting an exceptional refund request, contact us so that we can address the billing or service issue. Requesting both a refund and a chargeback for the same transaction may delay resolution. We may reject fraudulent, repetitive, bulk, or otherwise abusive requests.
11. Account Treatment After a Refund
When a refund is approved for a duplicate or incorrect charge, unauthorized transaction, or legal requirement, the related paid subscription, points, and other digital entitlements may be removed immediately. The notice of resolution will explain any service Credits or subscription extension. A refund does not release you from compliance obligations arising during your use of the service or change any provision of the Terms of Service that survives termination.
12. Policy Updates
We may update this Policy to reflect changes to our products, payment channels, or legal requirements. We will provide notice of material changes on the website, within the account, or through another reasonable method. Unless applicable law requires otherwise, changes apply only to transactions occurring after the changes take effect. The Last Updated date at the top identifies the current version.
